Idaho — banned (strictest)

Utah — inhalables banned
HB 54 (effective May 7, 2025) bans smokable/inhalable hemp and various intoxicating cannabinoids outside the medical system; ingestibles are allowed only through licensed retailers with per-SKU registration and dose caps. THCA flower and pre-rolls are prohibited at retail.
Wyoming — banned
SF 32 (effective July 1, 2024) added delta-8 to Schedule I and applies the 0.3% limit to all THC forms, explicitly covering THCA flower. A 10th Circuit ruling in October 2025 held the ban is not preempted by the Farm Bill, so shipping in is not protected. THCA is not legal at retail.
New Mexico — comparatively open
New Mexico has no blanket ban. A 2025 state environment-department emergency rule targets synthetic/converted cannabinoids at in-state facilities, while THCA must stay within the 0.3% Delta-9 limit. It remains the most accessible state in this region for compliant hemp — verify current rules before stocking.
North Dakota — banned
North Dakota applies a total-THC standard and has excluded delta-8 and similar cannabinoids from its hemp definition. THCA flower is not lawful at general retail; intoxicants run through the medical program.
South Dakota — banned
South Dakota bans the manufacture, distribution, and sale of chemically modified or intoxicating hemp cannabinoids regardless of Delta-9 level. Intoxicating THCA is prohibited outside the medical program.
Nebraska — high-enforcement gray zone
Nebraska has not enacted a comprehensive intoxicant standard, but the Attorney General has issued cease-and-desist letters to hundreds of stores and the governor has targeted synthetic THC by executive action.
