California — inhalable hemp banned at retail

AB 8 (signed October 2025) bans inhalable hemp products — flower, pre-rolls, and vapes — regardless of THC content, with the first phase effective January 1, 2026. Earlier CDPH rules already barred detectable THC in hemp food, beverages, and supplements. THCA flower is not sellable at general retail in California; intoxicating hemp is routed to the licensed cannabis system. Verify current rules before stocking.

Oregon — dispensary-only

Washington — cannabis-system only

Arizona — treated as a controlled substance

Under a 2024 Attorney General opinion, hemp-synthesized intoxicants are treated as Schedule I and limited to licensed dispensaries. THCA flower and synthesized intoxicants are not legal to sell to Arizona consumers at general retail. (Status rests on the AG opinion; verify any newer guidance.)

Alaska — marijuana-system only

Alaska channels intoxicating hemp, including THCA-rich flower, into its AMCO-licensed marijuana system, and a 2025 federal court ruling upheld that approach. THCA is not sold as retail hemp.

Hawaii — most intoxicating hemp banned at retail

Hawaii's Department of Health interim rules permit only select oral formats with a low per-serving THC cap; retail THCA flower is not permitted, and intoxicating hemp is barred from smoke shops, convenience stores, and online sales to residents. A registration system took effect January 1, 2026.
