THCA Legal Status in Alabama — 2026
Alabama's HB 445, effective July 1, 2025, bans all smokable and inhalable hemp products — including THCA flower, vapes, and pre-rolls — and treats sale or distribution as a felony under a total-THC standard. Ingestible hemp products remain legal only within tight caps and require Alabama ABC Board licensing, and cannot be sold online to Alabama consumers. Non-intoxicating CBD generally remains available. Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight.
