THCA Legal Status in Alaska — 2026

Alaska restricts intoxicating hemp-derived products — including smokable THCA flower and hemp-derived delta-9 THC — to state-licensed marijuana retailers regulated by AMCO. Amendments to 3 AAC 306 (effective November 3, 2023) treat consumable hemp products containing delta-9 THC as marijuana products subject to licensing; because THCA converts to delta-9 when heated, smokable THCA flower falls under marijuana rules. A federal court decision in May 2025 upheld these restrictions. These products cannot lawfully be sold through general retail. This is not legal advice.

Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight.
