THCA Legal Status in Arkansas — 2026
Arkansas Act 629 of 2023 (SB 358) bans hemp-derived intoxicants — including delta-8, delta-10, converted/synthetic THC, and any hemp product exceeding 0.3% delta-9 — covering sale, manufacture, possession, and importation. The Eighth Circuit upheld Act 629 (June 24, 2025), and in March 2026 a federal judge dismissed the remaining challenge, so the state is enforcing the ban. THCA flower is effectively barred; only non-intoxicating CBD and licensed medical cannabis remain legal. This is not legal advice.

Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight.
