THCA Legal Status in California — 2026
California prohibits inhalable hemp products containing detectable THC from general retail. AB-45 (2021) authorized hemp consumables, but CDPH Emergency Regulations (effective September 2024) imposed a 21+ minimum and effectively barred detectable-THC hemp products; AB 8 (2025) then codified that hemp flower, pre-rolls, and inhalable hemp products containing THC cannot be sold through general retail, operative around January 1, 2026. THCA flower and higher-potency hemp-derived delta-9 are effectively available only through DCC-licensed dispensaries. This is not legal advice.

Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state.
