Idaho is among the strictest states: hemp is defined with a 0.3% total delta-9 cap under Idaho Code 22-1703, but the Idaho State Department of Agriculture enforces a 0.0% THC standard for products sold at retail. Any detectable THC — including THCA flower, smokable hemp, and hemp-derived delta-9 — renders a product a controlled substance under Idaho Code 37-2705. Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state.
