THCA Legal Status in Louisiana — 2026
Louisiana's Act 752 of 2024 (HB 952), effective January 1, 2025, prohibits the retail sale of all inhalable consumable hemp — THCA flower, pre-rolls, vapes, and dabs. Non-inhalable products remain legal only at licensed 21+ retailers within caps, and gas stations/convenience stores are barred. An industry challenge on Farm Bill preemption grounds remains pending as of mid-2026 with no injunction, so Act 752 is enforced. This is not legal advice.

Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state.
