THCA Legal Status in Louisiana: 2026
Louisiana's Act 752 of 2024 (HB 952), effective January 1, 2025, prohibits the retail sale of all inhalable consumable hemp — THCA flower, pre-rolls, vapes, and dabs. Non-inhalable products remain legal only at licensed 21+ retailers within caps, and gas stations/convenience stores are barred. An industry challenge on Farm Bill preemption grounds remains pending as of mid-2026 with no injunction, so Act 752 is enforced. This is not legal advice.

Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state. What is the December 11, 2026 federal deadline?
Section 781 of Public Law 119-37 (signed November 12, 2025) redefines hemp to include a total-THC standard that counts THCA, with a 0.4 mg total THC per container cap on finished products. It was scheduled for November 12, 2026; H.R. 6500, signed September 2, 2026, moved the date to December 11, 2026 for naturally occurring cannabinoids such as THCA and hemp Delta-9.
