THCA Legal Status in New Jersey: 2026
New Jersey enacted S4509 (P.L. 2025, c. 215), signed January 12, 2026, redefining hemp with a 0.3% total-THC standard that counts THCA post-decarboxylation and all THC isomers. Products above that threshold are deemed cannabis and may be sold only by licensed cannabis retailers. Bans on synthetic cannabinoids and online hemp sales took effect January 13, 2026, and the retail ban on intoxicating hemp products (including THCA flower and hemp-derived delta-9) takes effect April 13, 2026. Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state.
