THCA Legal Status in Oregon — 2026
Oregon strictly limits adult-use cannabinoids in general-market hemp products under HB 3000 (2021) and OLCC/ODA rules, capping total THC at very low levels and routing higher-potency products into the licensed cannabis system. Total THC is calculated as delta-9 plus 0.877 x THCA, so smokable THCA flower exceeds the hemp threshold and is treated as marijuana that may be sold only through OLCC-licensed dispensaries to adults 21+. Hemp-derived delta-9 products above the cap are likewise restricted to the licensed channel. This is not legal advice.

Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state.
