THCA Legal Status in South Dakota: 2026
South Dakota's HB 1125, effective July 1, 2024, bans chemically derived/converted cannabinoids (such as delta-8) and applies a 0.3% total-THC (post-decarboxylation) standard enforced by the Attorney General. THCA flower is the highest-risk category because heating converts it above 0.3% delta-9, and retail compliance sweeps began in 2025, so smokable THCA flower and hemp-derived intoxicants are effectively barred. Non-intoxicating CBD meeting the total-THC limit may remain available. This is not legal advice.

Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state. The Haze Connect sells only Farm Bill-compliant hemp products, third-party lab tested with publicly available Certificates of Analysis.
What is the December 11, 2026 federal deadline?
Section 781 of Public Law 119-37 (signed November 12, 2025) redefines hemp to include a total-THC standard that counts THCA, with a 0.4 mg total THC per container cap on finished products. It was scheduled for November 12, 2026; H.R. 6500, signed September 2, 2026, moved the date to December 11, 2026 for naturally occurring cannabinoids such as THCA and hemp Delta-9.
