Tennessee's Public Chapter 526 (HB 1376/SB 1413), signed May 21, 2025 and effective January 1, 2026, adopts a 0.3% total-THC standard that reclassifies most THCA flower as marijuana, bans online/remote hemp sales, and moves regulation to the Tennessee Alcoholic Beverage Commission. Under a litigation settlement, licensed retailers may sell existing inventory through June 30, 2026, after which high-THCA flower is off the legal market. Is hemp-derived THC federally legal?
Yes. Hemp-derived cannabinoids are federally legal under the 2018 Farm Bill when the product contains less than 0.3% Delta-9 THC by dry weight. However, individual states can and do impose their own stricter rules, so legality varies by state.
