Concentration is milligrams of THC divided by the weight of the product carrying it. A typical gummy weighs 4–5 grams — that's 4,000–5,000 milligrams of gummy. Put 10mg of delta-9 in it:

10mg THC ÷ 4,000mg gummy = 0.25% — under the 0.3% line. Legal hemp.

A 20mg gummy in a 7-gram format? Just over 0.28% — still compliant. On November 12, 2026 the federal definition switches to total THC (counting THCA) and adds a per-container cap on finished products — a rule aimed primarily at high-THCA flower and synthetic cannabinoids. The Senate voted August 8 to push the date to December 11 for naturally derived products; the House hasn't acted yet.
