Governor DeSantis vetoed a prohibition bill (SB 1698) on June 7, 2024, and the 2026 legislative session adjourned without a hemp ban, so hemp products testing at or below 0.3% delta-9 THC on a dry-weight basis remain lawful under Fla. Stat. 581.217 (subject to FDACS COA and packaging requirements). Hemp-derived Delta-9 edibles and gummies meeting that same 0.3% delta-9 threshold are likewise available to adults 21+. A federal provision (H.R. 5371) is scheduled to redefine hemp using a total-THC test effective November 12, 2026, which analysts expect to disqualify most current products.
