TL;DR
As of August 19, 2026, THCA vapes made from hemp with no more than 0.3% delta-9 THC are legal under federal law. Two clocks are ticking: the federal definition of hemp switches to a total-THC standard on November 12, 2026 (a delay to December 11 passed the Senate 90-6 on August 8 but is not law: the House hasn't acted), and a growing list of states apply their own total-THC math or restrict inhalable hemp products specifically. Vapes are treated differently from flower in several states, so check your state, not just "is THCA legal," but "are THCA vapes legal."
Legality questions about THCA usually get answered at the flower level. But vapes sit in their own regulatory lane in a surprising number of states, some ban smokable hemp but allow vapes, some do the reverse, and the federal deadline this fall applies to all of it. Here's where THCA vapes actually stand right now.
The Federal Baseline (August 2026)
The 2018 Farm Bill defines hemp by delta-9 THC only: at or under 0.3% by dry weight. THCA isn't part of that math today, which is why THCA vapes, flower and concentrates ship legally across most of the country.
That changes with Section 781 of last November's appropriations law, which redefines hemp using total THC, including THCA: effective November 12, 2026. On August 8 the Senate voted 90-6 to push that date to December 11, 2026 for naturally derived cannabinoids, but the House left town without taking it up and isn't back until the end of August. Until the two chambers agree, November 12 is still the law. We're tracking it closely: what the Senate actually did and what the deadline means in every state.
Two details worth knowing for vapes specifically: the new standard also caps finished products at 0.4 mg total THC per container: which no real vape can meet, and synthetic cannabinoids (delta-8 made by conversion, THC-O, HHC) get no extension at all under the Senate's delay. A live resin THCA vape is a naturally derived product; a converted-delta-8 cart is not. The distinction is about to matter a lot.
Where States Treat Vapes Differently
State law is where vape buyers get surprised. A few patterns:
Total-THC states. States like Florida, New York, Ohio, Georgia and (since March) Texas count THCA toward their hemp limit under state law, which pulls high-THCA products out of "hemp" there regardless of what federal law says today.
Inhalable-specific rules. New York prohibits hemp products sold "for the purpose of smoking" and caps hemp vape potency under its cannabinoid regulations. Illinois' new Hemp Act, effective November 12, 2026, bans hemp products "intended to be smoked or vaped" outright. Louisiana restricts inhalable hemp. These rules hit vapes even where edibles remain legal.
Age and registration rules. Nearly every state that allows hemp vapes requires 21+, and several require retailer registration. Legit retailers age-verify; that's a feature, not friction.

What About Texas?
Texas runs on two separate rules: a March 2026 state total-THC standard that removed THCA products from Texas retail, and a July 31 scheduling action covering delta-8, delta-10, THCP, THC-O and HHC. Hemp delta-9 under 0.3% remains legal in Texas. Litigation over the ban is active, a federal TRO was denied August 10 and a preliminary injunction motion is pending.
